If Scum shoot each other at any point in the game, OR if both Scum teams NK the same person the game turns out quite different I think.

Still though, mafia and werewolf shouldn't be able to reach a draw with a town loss. Draw should mean that no one wins or loses, thus it is a draw. The win cons should be:

town: You win when all the bad guys are gone.
scum faction: You win when you have the majority and there are no other killers.

I actually reread the win cons I gave very closely because I wanted to make sure I got it right. Town is really the only loser here, and that's because Day ends before Night begins. So Town is gone before night happens and Night is when Scum shoot. And since you need 1 member of your faction alive to achieve the win con, and both Scum die at the same time while Town is already dead, that simply means basically everyone loses, but Town is dead before they have a say on who wins.

I'm under the theory that if nobody hits scum (town lynches or scum nightkills) then the game is inevitably going to lead to a kingmaker.

And if everyone is failing at finding scum, then the game more or less deserves to go to kingmaker.
