The problem with HEM dying is that he was looking pretty buddy buddy with Tor before the end of D3. I wouldn't expect Tor to kill the person who tried to protect him as town. I wouldn't expect mafia not to kill the tracker over someone who looked pretty vanilla by nightfall. So in all honesty it makes sense as a mulch framing more than a Tor framing.
