In the US, the tomato is legally taxed as a vegetable in terms of customs and tariffs. This is because the terms "fruit" and "vegetable" were based on kind-of-arbitrary culinary understandings and uses. Also, knowing US politics, probably had something to do with lobbying and a friend of someone's getting very rich on the decision.

There are probably similar decisions in other democratic societies in the western world.
