Depends on the scumteam - they might think it would still leave them in a better position, since their major obstacle is removed from the game. You're giving them the opportunity to make that choice - scum can quickhammer if it puts them in a better position, or they can not. I suppose mafia could think it's a good idea to trade a mafia for a chosen townie (I wouldn't), but this would always be a possibility when someone is at L-1. I'm not sure what the contradiction there is.
