In other words, there's no provision in law or otherwise to extend first amendment protection to privately owned and operated web sites. I log everything. I have to because I work remotely most of the time and IM is a large part of how I communicate with people I work with. I never know when someone is going to send me something that I'm going to have to go and find later.
I also take the same approach in my personal life. I keep journals and log books, I take notes in meetings and I've gotten really good at writing in short-hand.
Basically I live by this mantra: If it isn't written down somewhere it didn't happen.
@Oman: I have no particular interest in CJmiller and I really couldn't care less whether he gets banned or not. I'm not even sure what everyone has their panties in a twist over. I just commented because it's a lame argument. If ignorance was a litmus test for having an MS account there would be a hell of a lot less people here.
BTW shouldn't this entire discussion be moved to the ban thread?-

I've read them, and I agree with Thok.
CJMiller may well have a point of view on things that I find offensive (though what he says in scumchat is outside the scope of my moderation, and frankly I find the habit of quoting scumchat in an attempt to make people look bad/ignorant/etc. tedious). What he said here, however, was clearly a reaction to a joke which he felt (whether correctly or not) was at his expense. I don't think this is a clear case of "he crossed the line", and I chose to be lenient withbothsides.
If you want to start a discussion on the use of "Gay" as an insult and have an enlightened discussion about that, feel free to start one. Just understand that trolling isn't an effective method of enlightened discussion.-
