Also of course Penguin is going to look at least somewhat town from their vote. That's the whole point of bussing, if an vote is made at the moment where anyone would say it looks like obvious bussing. It's failed it's purpose.
My argument is more that Penguin looked like he was informed of Jake's role beforehand, AKA scum partner. He always made sure to stay at the forefront in criticizing Jake, and their vote at the end was engineered to look town because that's the whole purpose.

I also detect in their ISO an distinct level of difference in treatment of Jake compared to other slots at any other time in this game. Which was an leading factor in me suspecting theatrics between the two.
