I really don't see Hiraki as scum because of that, though. Scum would have no reason to bail on a wagon last minute and then go back and hammer when they could coast until lynch without attracting much flack. So Hiraki really just strikes me as skittish town.

This isn't my logic at all. I've been suspicious of Toro for a while now (see my ISO for more information) and his hammer and attempt to push the crap Hiraki wagon just put things over the edge.
The entire Hiraki/Toro wall-fight kind of makes my head spin right now, so I'll have to leave combing over it for gems of enlightenment to later.
