The trial - arraignment hearing

The judge, Lord Trevor Goodchild, takes his place, as the court clerk speaks,

"The arraignment hearing for the indictment against Lord Kiwieagle II on charges of war crimes and crimes against humanity, brought by the late Lemaness Nicatilpoi, case number 1047 dated 18th September 2011.

"Charges for war crimes,

"Count one charge, for war of aggression against Fallen Angels, in the Fallen Angels War.

"Count two charge, for war of aggression against Mistotopia in the Second Mistotopian War.

"Count three charge, for betrayal against Astariel in the Chesstopian War.

"Count four charge, for betrayal against Melodica and Mistotopia in the Dinotopian War.

"Count four lesser charge, for war of aggression against Dinotopia in the Dinotopian War.

"Charges for crimes against humanity,

"Count five charge, for mass murder of civilians through poisoning in Fallen Angels.

"Count six charge, for mass murder of civilians through poisoning in Melodica.

"Count seven charge, for murder of civilians through delegation in Mistotopia.

"Count eight charge, for mass murder of civilians through the use of biochemical weapons.

"The defendant may converse with his defence council, and is required to enter a plea of "Guilty" or "Not Guilty" for each charge."

The defense would like to note that Kiwi has entered Nolo Contendre pleas on Counts: First, Second, Third, Fifth, and Sixth, because wartime actions are not recognized as crimes in the Planet MafiaScum International Law, or lets face it, at least half of the world leaders in attendance here today are guilty of said crimes.

At this time, the defense moves to Dismiss this case on the following grounds: This trial is compromised. Draconia and Flying Kiwi have engaged in wartime activities, and therefore any delegation from Draconia cannot be considered impartial or fair to my client. Furthermore, this trial should be dismissed on the grounds that Lemaness Nicatilpoi can no longer bring charges up upon Kiwi on account of his passing away last week. Also, Flying Kiwi currently has no government in which to act in substitution with Nicatipoi. Which also means my client can not be charged for the same crime again at a later date. Unless someone can prove that my client is directly responsible for the attacks in which Nicatipoi became deceased. At which time Kiwi can be brought up on those charges as well as these charges reopened.

The defense would also like to add that it is not the defenses responsibility to make sure all proceedings are done correctly, the burden of that falls on the prosecution, thus my client cannot be held responsible for any inappropriate mishandling of the law.

After the attack,

But just when it seemed things couldn't get any worse, Lemaness Nicatilpoi, the only person showing any leadership, was found dead. The house he was staying in had been hit by several missiles, and he was partially crushed as the building collapsed. His former second-in-command, Sir Selinsarb Ykalce, is now in control. He has stated that Kiwieagle and most of the other prisoners are still alive and secure, and urges Draconia to send in the support needed for a fair trial.
